Information about Processing of Personal Data

 

The Office for the Protection of Competition (hereinafter referred to as „the Office“ or „the controller“) processes a personal data in accordance with the requirements of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as „the GDPR Regulation“).

The purposes of the processing of your personal data

The Office processes your personal data primarily for following purposes:

a)      compliance with a legal obligation applied to the Office;

b)      performance of a contract, or implementation of the measures taken before concluding a contract;

c)       performance of a task carried out in the public interest or in the exercise of official authority vested in the Office;

d)      legitimate interest of the Office;

e)      in exceptional circumstances, the personal data can be processed on the bases of a granted consent, which always represents indication of your free, specific, informed and unambiguous will. The consent may be withdrawn at any time.

 

The Office processes your personal data limited to what is necessary in relation to the specific purpose, on a proper legal basis and for no longer than is necessary for the specific purpose. After the fulfilment of the purpose, the Office may process your personal data for other purpose as well, which concerns in particular processing of personal data for archiving purposes in the public interest.

 

The activities of the Office, which concern processing of your personal data

Within the competence of the Office, your personal data are processed mainly at: investigation of complaints, conducting administrative proceedings, management of personal and payroll administration, including selection procedures, handling complaints, requests, questions, Office's procurement procedures, sector inquiries, carrying out inspections, concluding agreements, and activities related to the agenda of state aid.  

 

The manner of the processing of personal data and their protection

When processing personal data, the Office always does that in a manner that ensures maximum security and prevention against abuse of the personal data. The Office shall process the personal data both by automated and manual means. No automated decision-making activity of the Office exists, i. e. there is no decision-making activity exclusively based on the automated processing, which would result in any legal effects, or it would have any impact on you in a similar way.

 

Recipients of your personal data

Your personal data are transferred to third persons only in situation when such obligation is imposed by the law, or where it is necessary for protection and exercise of the rights of the Office.

Your personal data can be transferred mainly to these recipients: other public authorities, parties to the proceedings, persons who demonstrated a legal interest on the access to the file, the legal counsellors representing parties to the proceedings or persons who demonstrated a legal interest on the access to the file, members of a remonstrance committee, expert witnesses, and a court. 

 

The period for which your personal data are stored

The personal data are stored for necessary period only. The period is individual for specific manner of the processing, and it is set by a currently applicable file retention and disposition schedule of the Office, issued in compliance with the Act No. 499/2004 Coll., on Archiving and Records Management, as amended. After that period, the personal data are disposed, except selected documents in compliance with the abovementioned Act on Archiving.

 

Your rights related to the processing of personal data

In relation to protection of your personal data, you have a right:

1. to request the Office for access to personal data concerning your person;

2. to request the Office for rectification of inaccurate personal data or renewal of incomplete personal data concerning your person;

3. to request the Office for erasure of personal data concerning your person, if you consider that

    a.       the Office has no more purpose for processing your personal data, respectively your personal data are no more necessary for the purposes for which they were collected or processed in another manner,

    b.      your personal data are processed illegally;

4. to request the Office for restriction of processing of your personal data;

5. to object to processing of your personal data, if the data are processed for a purpose of performance of a task carried out in the public interest or in the exercise of official authority, or for a purpose of a legitimate interest of the controller or of the third party;

6. to lodge a complaint with the Office for Personal Data Protection, in case you consider that your right to protection of personal data has been infringed.

 

The abovementioned rights can be exercised before the Office in writing, which includes the data box or electronic communication services, sent to the e-mail of e-registry of the Office or to the e-mail dpo@uohs.cz.

 

If the processing of your personal data is subject to your consent, you have the right to withdraw your consent at any time. Such withdrawal does not affect the legality of the processing based on consent before its withdrawal.
